1. The Services

FHM Turf provides software for turf installers and home-trade businesses — including estimating tools, CRM, demos, trials, and related lead-generation and marketing services. Demo environments and trials are provided for evaluation; data in demo environments may be fictional and may be reset at any time.

2. Accounts and trials

You agree to provide accurate information when signing up for a demo or trial, to keep your login credentials secure, and to use the Services only for your own business evaluation and operations. Trials are limited-time evaluations; we may modify, extend, or end a trial at our discretion. Paid services, when purchased, are governed by the order and agreement you sign at purchase.

3. Acceptable use

• No unlawful, infringing, or deceptive use of the Services;
• No attempting to copy, scrape, reverse-engineer, or recreate the software or its components;
• No interfering with the operation or security of the Services;
• No use of the Services to send spam or unlawful communications.

4. Intellectual property

The Services — including software, designs, text, graphics, and trademarks such as "FHM Turf" — are owned by Fortune House Media LLC or its licensors. You receive a limited, revocable, non-exclusive license to use the Services for their intended purpose. No other rights are granted.

5. SMS messaging terms

FHM Turf offers text message (SMS) communications related to demos, trials, estimates, appointment reminders, customer care, and service updates. We do not use text messaging for marketing or promotional offers.

6. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Estimates and outputs generated by the Services are tools to assist your business and are not guarantees of project cost, outcome, or revenue.

7. Limitation of liability

To the fullest extent permitted by law, FHM Turf will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amounts you paid us for the Services in the twelve months before the claim arose (or $100 if you have paid nothing).

8. Changes

We may update the Services and these Terms from time to time. The "Effective date" above shows when these Terms were last revised. Continued use of the Services after changes take effect constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in New Jersey.

10. Age restriction

The Services are intended for use by businesses and individuals who are at least 18 years old. By using the Services or opting in to receive text messages, you represent that you are 18 years of age or older.
